Dealing with bill collectors can be a stressful time. The unexpected calls in the middle of dinner, the calls when you are dealing with a family issue. The calls in general can really stress a person to her or her max. What makes it worse is if you are in a bad financial situation. A negative financial situation can amplify even the simplest of problems.

The good news is that there are many ways to turn a bad situation into a good one. Most creditors are aware of the Fair Debt Collection Practices Act, and strive to adhere to it. There are those that go against every rule it seems to have. You can bargain for better terms, deferred payments and many other possible arrangements. It is in the creditor's best interest to try to make things right when you are having a tough time. Many creditors will help if they are aware of your situation beforehand. Do not wait until it is too late and you have missed one or several payments. It is always best to clear it up in the beginning. If you see a cash shortage one month, be prepared to call your creditors before they call you. They may suspend late and over the credit limit fees if you ask. It never hurts to ask, it is always free.

Many times a creditor will work with you before they turn your account over to a collection agency. As long as your account remains under their care and is current, or some kind of arrangement has been made, you should be okay. Many creditors will let you skip a payment altogether, with you only paying the interest. This happens frequently with car payments and secured loans. Simply put, do not let it get to the point where you are months behind. You have much more room to negotiate before it gets to that point.

Before you contact your creditors, have a plan of action. Write down your monthly expenses and income in a spreadsheet. List your most important bills, such as court ordered child support, taxes first. These types of bills are usually less flexible in the payment arrangements. They will garnish wages and keep your tax refunds. If possible, try to limit your night outs and think of every possible way to save money. Do you really need that 3 dollar coffee every morning? Might not sound like much, but those three dollars have a way of adding up. That could be a nice extra payment to a creditor. The more you pay your creditors, the less interest you pay. In turn, the more you have for yourself in the long run. If you have cut your budget to the bare bones, you may want to think of ways to increase your income. If it is possible to work overtime at work, take the opportunity. If you have a significant other who can work, it may be a good idea for them to start. After having all your income and expense information, present it to your creditor. Be sure to pad the numbers a little so you have room for error. Most will let you know what they think as well as any feedback or suggestions.

When you contact your creditors, be certain to keep notes on what you said and when you said it for each one. Log the times and names of the people you spoke with. Ask them to send you a confirmation letter in the mail confirming your arrangements. If your arrangements are not recorded in written format, you may assume they are not valid. Even if you have the times and names of the people who approved the arrangements, it is better to be safe than sorry.

Of course the best way to stay out of trouble with creditors is not to get into trouble in the first place. This is not the reality for some people however. Do not forget that your obligations will follow you until they are paid in full. There are stories where bill collectors go after debts that are twenty years old and more. Always think twice before going into debt, do you really need what you are buying?
